Terms of Service

These terms govern your use of Ekuya - the dashboard, the AI assistant connected to your WhatsApp Business number, and everything at ekuya.com. By creating an account or connecting a WhatsApp number, you agree to them.

1. The service

Ekuya is a dashboard and AI assistant that connects to a business's own WhatsApp Business Account, replies to customers using information the business provides, and hands conversations off to a person when asked. We act as a Meta Tech Provider to enable this connection on your behalf.

2. Eligibility & your account

  • You must be at least 18 and authorized to act on behalf of the business you're signing up for.
  • You're responsible for keeping your password and any team member accounts you create secure, and for all activity under your account.
  • If you add team members, you're responsible for their conduct on the platform and for removing their access when appropriate.
  • Your WhatsApp number must already be, or become, a WhatsApp Business Account in good standing with Meta - we don't control Meta's own approval process.

3. Trial & billing

New accounts start on the Trial plan - free, no card required, with a limited number of messages included per month (see current limits on our pricing page). Continuing past the Trial plan's limits requires upgrading to a paid plan. Plans, pricing, and payment methods are shown at checkout and may change with notice; changes don't apply retroactively to a billing period you've already paid for.

  • Subscriptions renew automatically each billing period unless cancelled beforehand.
  • You can cancel any time from your dashboard; cancellation takes effect at the end of the current billing period, and we don't provide partial-period refunds except where required by law.
  • If a payment fails and isn't resolved within a reasonable grace period, we may pause your assistant until billing is sorted out - your data isn't deleted for a billing pause.

4. Acceptable use

You agree not to use Ekuya to:

  • Send unsolicited bulk messages, spam, or messages a recipient hasn't consented to receive.
  • Impersonate another person or business, or connect a WhatsApp number you're not authorized to use.
  • Distribute illegal content, or content that harasses, threatens, or exploits anyone - including any content sexualizing minors, which we report as required by law.
  • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the platform or another tenant's data.

We may suspend or terminate accounts that violate this section, with or without notice depending on severity.

5. WhatsApp & Meta compliance

Meta requires that a WhatsApp business bot stay scoped to a specific task - support, bookings, order tracking, sales - rather than acting as an open-ended, general-purpose chatbot. This has been an active enforcement policy since January 15, 2026. Keep your assistant's instructions focused on your actual business for this reason, not just for reply quality.

Your use of WhatsApp through Ekuya is also subject to Meta's own WhatsApp Business Messaging Policy and Terms of Service. If Meta suspends or restricts your WhatsApp Business Account, we'll pass that notice along, but resolving it with Meta is between you and Meta - we can't override their decisions.

6. AI limitations

Ekuya's assistant is built to answer only from the business information you provide and to say so when it doesn't know something - but AI-generated replies can still be wrong, incomplete, or oddly phrased. You're responsible for reviewing what you enter as business information, for monitoring your conversations, and for verifying anything the assistant flags as a booking, purchase, or other business event before treating it as confirmed.

Ekuya is not liable for business decisions made solely on the basis of an AI-generated reply, or for losses arising from an inaccurate reply, to the extent permitted by law.

7. Your content & data

You retain ownership of your business information and your customers' conversation data. By using Ekuya, you grant us a license to store and process that data solely to provide the service to you - see our Privacy Policy for the full detail on how that works. You're responsible for having the right to share any content you upload (including images) and for it complying with applicable law.

8. Availability

We aim for high reliability, including automatic fallback across multiple reply providers so a single outage doesn't leave your customers unanswered - but we don't guarantee uninterrupted or error-free service. Scheduled maintenance, third-party outages (including WhatsApp's or an AI provider's own downtime), and events outside our reasonable control may affect availability.

9. Termination

You can stop using Ekuya and delete your account at any time from your dashboard. We may suspend or terminate your account for violating these terms, for WhatsApp policy violations reported to us by Meta, or for non-payment after a reasonable notice period. On termination, your data is handled as described in our Privacy Policy's retention section.

10. Liability

To the maximum extent permitted by law, Ekuya and its operator aren't liable for indirect, incidental, or consequential damages arising from your use of the service, including lost profits or lost business, even if advised of the possibility. Our total liability for any claim relating to the service is limited to the amount you paid us in the 3 months before the claim arose.

Nothing in these terms limits liability where the law doesn't allow it to be limited.

11. Governing law

These terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of Indonesia, unless applicable consumer-protection law requires otherwise.

12. Changes to these terms

We may update these terms as the product changes. We'll update the date at the top of this page, and for material changes, notify account owners by email before the change takes effect. Continuing to use Ekuya after a change takes effect means you accept the updated terms.
